Service
- The provide reserves the right to refuse service to anyone for any
reason.
- The provider will conduct routine backups of the
system at intervals scheduled by the management, however,
the user is responsible for the backups of the databases and content
of their own web site.
- The user may employ whatever content the user choses,
but will ensure that all content does not violate the laws of the United
States or whatever state the user is located in. Examples of content
banned by the laws of the United States include, but are not limited to:
child pornography, threats, or inciting violence.
- The user may not use the disk space provided by the
provider to store any illegal materials, or any materials that are not
intended for use by the actual web site. In other words, you may not
store any files not related to your site.
- The user may not run any software on the web space
not approved by the provider. Absolutely no IRC or chat programs that
are not provided for in the install scripts included in the packages unless
approved in writing by the provider, nor can you run any daemons (except for VPS customers).
- The provider is not financially responsible for
outages that may occur from time to time or any loses occurred by the user.
- The provider shall not be held legally responsible
for the content the user may post on the server. If any laws or the
terms of this Terms of Service are violated by the user, the provider may
terminate the web services provided to the user immediately without prorating
or refund.
- The provider provides web hosting services, but does
not provide support for software the user may run on these services. The
user shall go to the software company or author for that type of
support. We only support the hosting itself. This applies even to
programs provided for in the user install scripts.
- Absolutely no using our mail servers to spam at any time. Spamming
is defined as sending unsolicited emails to anyone where there is no prior
financial relationship. If you own an oscommerce store, and people sign
up for your newsletters, etc, you may email them if you can prove it.
Anyone caught using our servers for purpose of spamming, will have their
service revoked immediately, and will not receive any form of
reimbursement. There will be NO bulk mailing or bulk mail scripts
allowed on shared hosting! Our shared hosting servers are set to limit
outgoing mail to 100 messages per hour per domain. A VPS customer
has no restrictions, but no spamming!
- We are never responsible for losses due to outages at any time, with the exception of any guarantees of uptime compensation. This means that if you have an outage that causes perceived or real losses with your customers we are not liable except to credit your account on the basis of up to 1/2 month of service, as per the SLA.
Privacy Agreement
HelvaWebHost does NOT believe in the release
of personal information without written permission to third parties. So we
will NOT release any personal information given to us by our customers except as
the law requires.
If the customer is buying a domain name, then ICANN requires that
we provide them with information concerning the owner of that domain by
law. Other than that, we will not supply any information to any party
without a court order that is duly signed by a person acting on behalf and with
the authority of any court within the juridiction of the United States or its
territories.
HelvaWebHost never sells your personal information to any
party. To us, sale of email addresses, business or residual addresses,
phone numbers, names or domain names is a violation of the privacy of our
customers, and we only use that information in order to conduct business with
said customer, and for no other reason.
